2 04-06-2014 Having regard to the nature of allegation for offence under Section 33/52 of the Indian Penal Code and Section 27, 29 and 33 of the Indian Bird Protection Act, this Court, taking into account that not only the petitioners were not named in the First Information Report but, in fact their complicity has surfaced from the some of report given by the officials that the petitioners had been found to be catching fish from the dam, and taking into account that the petitioners have also got no criminal antecedent, would direct the petitioners, namely, Ashok Yadav, Ranjit Yadav @ Ramjeet Yadav, Parsuram Yadav, Mastan Turi and Nandlal Turi to surrender within a period of four weeks from today and in case they do so, they shall be released on bail on furnishing bail

bond of Rs. 10,000/- (ten thousand) each with two sureties of the like amount each to the satisfaction of Sri Shyamal Kumar, Judicial Magistrate, 1^st Class, Jamui in connection with Complaint Case No. 251C-2 of 2012, subject to the conditions as laid down under Section 438(2) of the Cr.P.C. as also subject to the following three conditions:-

(i) The two bail bonds will be furnished by a close family

relative.

(ii) The petitioners will remain present in course of trial on each and every day and their absence even for two consecutive days would automatically entail the consequences of cancellation of their bail.

(iii) The petitioners in case are now made accused in any other criminal case, that would itself lead to cancellation of their bail.
