Case No. 717 of 2013 dated 02.12.2013 instituted under Sections 328/379/420/411 of the Indian Penal Code. Learned counsel for the petitioner submits that he is not named in the F.I.R. and only lateron it is the prosecution case that the truck has been recovered from his possession. Learned counsel submits that during investigation various discrepancies have come and it appears that the owner of the truck himself has expressed the apprehension that the truck may be on the border of Bihar and Bengal which means that he was aware of its movement and further that the petitioner had paid advance money for purchase of the truck. It is further submitted that a compromise petition has also been filed in the Court below between the owner of the truck and the petitioner.

Learned A.P.P., after going through the case diary, submits that the petitioner along with another co-accused was caught with the truck and has also been identified by the Khalasi of the truck.

Considering the facts and circumstances of the case and submissions of learned counsels for the parties, this Court is not inclined to enlarge the petitioner on bail. The application stands dismissed.

However, the Court below is directed to expedite

the trial and conclude the same within six months.
