The petitioner is apprehending his arrest in a complaint case in which processes have been directed to be issued after cognizance being taken for the offences punishable under Sections 406 of the Indian Penal Code and 3/4 of Dowry Prohibition Act.

It is alleged that the complainant fixed the marriage of his daughter with the petitioner when Rs.50,000/was paid and engagement was performed but thereafter further demand of Rs.2,00,000/- and other articles were made, but due to non-fulfillment of the same, the marriage could not be performed.

It is submitted by learned counsel for the petitioner that during investigation accusation was found false

and final form was submitted but subsequently on protest the cognizance has been taken.

Considering the aforesaid facts, let the above named petitioner be released on anticipatory bail in the event of his arrest or surrender before the learned court below within a period of twelve weeks from today, on furnishing bail bonds of Rs.10,000/- (Ten thousand) with two sureties of the like amount each to the satisfaction of learned Judicial Magistrate, Ist Class, Motihari, East Champaran in connection with Complaint Case No. C-677 of 2012, subject to the conditions as laid down under Section 438(2) of the Cr.P.C.
