2 19-04-2014 Petitioners are apprehending their arrest in a case registered for the offences punishable under Sections 147, 149, 323, 341, 379, 427, 504, 506 of the I.P.C and 3(1)(iii)(x) of the SC & ST (Prevention of Atrocities) Act.

Accusations are of making assault, abusing by calling caste name, spitting and urinating on the body of the informant and taking away shoes, cash and other articles from the shop of the informant.

It is submitted by learned counsel for the petitioners that for the occurrence of 27.03.2013 the F.I.R. was registered on 18.04.2013 when petitioners’ side lodged Chainpur P.S. Case No. 37 of 2013 against the informant’s side making accusation under Sections 147, 323, 325, 341, 379, 427, 504 of the I.P.C. on 27.03.2013 itself.

Considering the delayed lodging of the case and the case lodged by the petitioners’ side at earlier point of time, let the petitioners, above named, in the event of their arrest or surrender before the Court below within a period of 12 weeks from today, be released on anticipatory bail on furnishing bail bond of Rs. 10,000/-(ten thousand) each with two sureties of the like amount each to the satisfaction of learned Chief Judicial Magistrate, Bhabua, Kaimur in connection with SC/ST Bhabua P.S. Case No. 14 of 2013, subject to the conditions as laid down under Section 438(2) of the Cr.P.C.
