Petitioner is languishing in custody since 24.08.2013 in a case registered for the offences punishable under Sections 366A, 379/34 of the I.P.C.

Accusation is of kidnapping the minor daughter of the informant. The victim in her 164 Cr.P.C. statement got her age recorded as 18 years when learned Court below also assessed as such and as per medical opinion the victim was found between 17-19 years. The victim in her 164 Cr.P.C. statement stated that she went in the company of the petitioner to Rishikesh and thereafter on the threatening of her parents the petitioner brought the victim at Sikta station.
A statement has been made in para 3 of the petition that petitioner has no criminal antecedent.
Considering the 164 Cr.P.C. statement of the victim, let the petitioner, above named, be released on bail on furnishing bail bond of Rs. 10,000/-(ten thousand) with two
