The petitioners are languishing in custody since 19.10.2012 and 23.11.2012 in a case registered for the offence punishable under Section 394 of the Indian Penal Code. The accusation is of robbing the informant on the pistol point.
It is submitted by learned counsel for the petitioners that there is no recovery from the petitioners when petitioners have not been put on TIP in spite of the fact that the informant claimed that he can identify the accused, if confronted.

Statement has been made in para 10 that the petitioner Fudo Mahto is accused in one other case when statement has been made in para 11 that petitioner Arun Mahto has no criminal antecedent.
Considering the aforesaid facts, let the above named petitioners, be released on bail on furnishing bail bonds of Rs.10,000/- (ten thousand) each with two sureties of the like amount each to the satisfaction of learned CJM, Saharsa in connection with Sonbarsa Raj (Kashnagar O.P.) P.S. Case No. 140 of 2012.
