7	25-07-2013 Heard learned counsels for the petitioner and the State.
	The petitioner is languishing in jail since 16.11.2012 in
	a case registered for the offences punishable under Sections 25(1-
	b)A and 26 of the Arms Act.

From the possession of the petitioner, one loaded country made pistol and seven live cartridges were recovered.

The criminal antecedent report of the petitioner at Flag‘A’ reflects that the petitioner is accused in four other cases when a supplementary affidavit has been filed to the effect that out of four cases, petitioner has been acquitted in three cases being Chenari P.S. Case Nos. 87 of 1994, 78 of 1996 and 79 of 1995 and at present only one case being Chenari P.S. Case No. 156 of 2002 is pending against the petitioner.

Considering the nature of recovery, period under custody and the fact that petitioner has been acquitted in three cases out of four cases, let the above named petitioner, be released

on bail, on furnishing bail bond of Rs. 10,000/- (ten thousand) with two sureties of the like amount each to the satisfaction of learned Chief Judicial Magistrate, Rohtas at Sasaram in connection with Chenari P.S. Case No. 136 of 2012.

Considering the criminal antecedent of the petitioner, learned court below shall cancel the bail bonds of the petitioner if he defaults for two consecutive occasions without any reasonable cause or if he substantially gets involved in similar nature of offence.
