JUSTICE DINESH KUMAR SINGH ORAL ORDER 8 25-07-2013 Heard learned counsels for the petitioner and the State. The petitioner is languishing in jail since 26.09.2012 in a case registered for the offences punishable under Sections 364, 302, 201 and 120B of the Indian Penal Code.

The brother of the informant went to Varanasi with Rs. 1.5 lacs for getting a land transferred through registered sale deed when he went missing on 21.09.2012. During investigation, it transpired that the victim was last seen in the company of coaccused Rakesh Yadav and his mother. It is alleged against the petitioner that on his confession, the dead body was recovered.

It is submitted by learned counsel for the petitioner that no motive has been alleged when except the confession before the police, there is nothing against the petitioner.
