The petitioners are apprehending their arrest in a case registered for the offences punishable under Sections 120B, 406, 407, 409, 415, 420 of the Indian Penal Code, 81(2)6, 81(3)(C) and 81(4) of the Bihar Value Added Tax Act. The accusation against the petitioners being the owners of the trucks in question that in connivance with cyber café operator, goods were being transported on the basis of forged transit permit by mentioning fake TIN number and other particulars to evade payment of taxes. It is submitted by learned counsel for the petitioners that the petitioners are neither the consignors nor the consignees and penalty imposed, has already been deposited, the receipts of the same have been brought on record as Annexures 2 and 3. event of arrest or surrender before the learned
court below within a period of twelve weeks from
today in connection with Mohania P.S. Case No. 379
of 2012 on furnishing bail bond of Rs.10,000/-(Ten
Thousand) each with two sureties of the like amount
each to the satisfaction of the learned C.J.M.
Bhabua, subject to the conditions as laid down under
Section 438(2) of the Code of Criminal Procedure.
