The petitioner is apprehending his arrest in a case registered for the offences punishable under Sections 120(B)/34 and 420 of the Indian Penal Code. It is alleged that the benefit under Indira Awas Scheme has been withdrawn against the dead sister-in-law (Bhabhi) of the informant by impersonating her when bank account of sister-in-law was identified by this petitioner. It is submitted by learned counsel for the petitioner that the amount has not been disclosed in the F.I.R. but in the subsequent statement, the informant suggested that Rs. 23,000/- was withdrawn. The petitioner undertakes to deposit Rs. 23,000/before the learned court below in connection with the present case which will be invested in some

fixed deposit scheme which will be subject to result
of the case.
Considering the aforesaid facts, let the
petitioner, above named, be released on bail in the
event of arrest or surrender before the learned
court below within a period of twelve weeks from
today in connection with Madhuban P.S. Case No. 31
of 2011 on furnishing bail bond of Rs.10,000/-(Ten
Thousand) with two sureties of the like amount each
to the satisfaction of the learned S.D.J.M.,
Sikarahana at Motihari, subject to the conditions
as laid down under Section 438(2) of the Code of
Criminal Procedure.
The bail bonds of the petitioner shall be
accepted by the learned court below on deposit of
the aforesaid amount.
