The petitioner is apprehending his arrest in a case registered for the offences punishable under Sections 120(B)/34, 307 and 353 of the Indian Penal Code.

It is alleged that the truck of the
petitioner was chased suspecting to be carrying
stones when the driver of the truck tried to flee
away and subsequently tried to dashed the police
jeep. The driver of the truck was apprehended who
named others. The petitioner is owner of the truck
in question.

It is submitted by learned counsel for the
petitioner that no stones were seized and admittedly
for accusation only driver can be held responsible.
Considering the aforesaid facts, let the
petitioner, above named, be released on bail in the
event of arrest or surrender before the learned

court below within a period of twelve weeks from
today in connection with Barbigha P.S. Case No. 250
of 2012 on furnishing bail bond of Rs.10,000/-(Ten
Thousand) with two sureties of the like amount each
to the satisfaction of the learned C.J.M.
Sheikhpura, subject to the conditions as laid down
under Section 438(2) of the Code of Criminal
Procedure.
