The petitioner is apprehending his arrest in a case registered for the offences punishable under Section 366A/34 of the Indian Penal Code. The accusation is of kidnapping the granddaughter of the informant. It is submitted by learned counsel for the petitioner that the victim girl has married with Ravi Kumar Sharma who is nephew of this petitioner and the First Information Report was lodged with inordinate delay. The petitioner undertakes to produce the victim girl Priti Kumari @ Khushboo Kumari before the learned court below on 30.04.2013 when the learned court below will record the statement of the victim girl.

Considering the same, let the petitioner,
above named be released on provisional anticipatory
bail for three months in the event of arrest or
surrender before the learned court below within a
period of twelve weeks from today in connection with
Bakhtiyarpur P.S. Case No. 174 of 2012 on furnishing
bail bond of Rs.10,000/-(Ten Thousand) with two
sureties of the like amount each to the satisfaction
of the learned C.J.M. Saharsa, subject to the
conditions as laid down under Section 438(2) of the
Code of Criminal Procedure.

The provisional bail of the petitioner will
be confirmed by the learned court below if the
victim girl admits that she of her own married with
Ravi Kumar Sharma.
