JUSTICE DINESH KUMAR SINGH ORAL ORDER 3 13-03-2013 Heard learned counsels for the petitioners and the State. The petitioners are apprehending their arrest in a case registered for the offences punishable under Section 366A/34 of the Indian Penal Code. The accusation is of kidnapping the minor daughter of the informant. It is submitted by learned counsel for the petitioners that the victim girl has married with Akhilesh Kumar who is son of petitioner nos. 1 and 2 when petitioner no.3 is another son of petitioner nos. 1 and 2. It is further submitted that the First Information Report was lodged with inordinate delay. Petitioners undertake to produce the victim girl before the learned court below on 30.04.2013 when the learned court below will record the statement of the victim girl.

Considering the aforesaid facts, let the
petitioners, above named, be released on provisional
anticipatory bail for three months in the event of
arrest or surrender before the learned court below
within a period of twelve weeks from today in
connection with Ramgarhwa P.S. Case No. 45 of 2012
on furnishing bail bond of Rs.10,000/-(Ten Thousand)
each with two sureties of the like amount each to
the satisfaction of the learned C.J.M. East
Champaran, Motihari, subject to the conditions as
laid down under Section 438(2) of the Code of
Criminal Procedure.

The provisional bail of the petitioners will
be confirmed by the learned court below if the
victim girl admits that she of her own married with
Akhilesh Kumar.
