ORAL ORDER
2 02-04-2013 Heard learned counsel for the petitioner and the
State.
The petitioner is apprehending his arrest in a
case registered for offence punishable under Sections 363,
366(A), 376/34 of the Indian Penal Code.
Accusation is of kidnapping minor daughter of
the informant and establishing sexual relationship on the
promise of marriage. The victim in her statement under
Section 164 of the Code of Criminal Procedure has stated that
she went to Delhi with the petitioner on her own and she
claims to have married with the petitioner. On medical
examination her age was assessed to be 14 to 17 when no sign
of sexual intercourse has been found.
It is submitted by the learned counsel for the
petitioner that for the occurrence of 1.10.2011, complaint was

filed on 21.11.2011 and the same was received before the learned court below on 21.11.2012. Statement has been made in paragraph-14 of the petition that petitioner has no criminal antecedent.
Considering the facts and circumstances of the case, let petitioner named above be released on anticipatory bail in the event of arrest or surrender before the learned court below within a period of twelve weeks from today in connection with Pirpainty P. S. Case No. 26/12 on furnishing bail bond of Rs.10,000/-(Ten thousand) with two sureties of the like amount each to the satisfaction of the C.J.M., Bhagalpur, subject to the conditions as laid down under Section 438(2) of the Code of Criminal Procedure.
