The petitioners are apprehending their arrest in a case registered for the offences punishable under Section 366A/34 of the Indian Penal Code. The accusation is of kidnapping the minor daughter of the informant. In 164 Cr. P.C. statement, the victim got her age recorded as 16 years where she stated that initially on 25.02.2012, Sachin established physical relationship for few times and thereafter on 05.04.2012, Sachin took the victim to Delhi by intoxicating. The victim further alleged that on 06.04.2012, Sachin, Dabloo, Sachin’s father and maternal uncle and 4-5 accused persons took the victim on the

It is submitted by learned counsel for the
petitioners that the age of the victim has been
assessed between 14-17 years when for occurrence of
05.04.2012, F.I.R. was registered on 13.04.2012 when
petitioner no. 2 was not named in the F.I.R.

Considering the thrust of accusation against
Sachin with whom as per 164 Cr. P.C. statement of
the victim appears that the victim had some
relationship from before and who is in custody, let
the petitioners, above named, be released on bail in
the event of arrest or surrender before the learned
court below within a period of twelve weeks from
today in connection with Dhamdaha P.S. Case No. 24
of 2012 on furnishing bail bond of Rs.10,000/-(Ten
Thousand) each with two sureties of the like amount
each to the satisfaction of the learned C.J.M.
Purnea, subject to the conditions as laid down under
Section 438(2) of the Code of Criminal Procedure.
