The petitioners are apprehending arrest in a case registered for the offences punishable under Sections 323, 341, 379, 384, 447, 504 and 506/34 of the Indian Penal Code.

It is alleged that the father of the informant who died 17 years prior to the occurrence, took loan from the petitioners’ side on interest and executed sale deed but again the petitioners’ side put pressure for transferring other land when on 21.11.2008, the informant was abused and threatened to kidnap the daughter of the informant when 30 pieces of bamboo of the informant were also cut away by the accused persons.

It is submitted by learned counsel for the petitioners that for the accusation of 21.11.2008, the FIR was lodged on 25.01.2009 when on 18.08.2009final form was submitted finding the accusation false when on 12.08.2010 the cognizance has been taken.

Considering the fact that during investigation the accusation was found false, let the above named petitioners be released on anticipatory bail, in the event of arrest or surrender before the learned Court below within a period of 12 weeks from today, on furnishing bail bond of Rs. 10,000/- (ten thousand) each with two sureties of the like amount each to the satisfaction of the learned Sub-divisional Judicial Magistrate, Sikarahana, East Champaran in connection with Patahi P.S. Case No. 05 of 2009, subject to the conditions as laid down under Section 438(2) Cr.P.C.
