The allegation against the petitioner is that Rs.24.55 lacs were transferred to the account of Ex-Mukhiya Sri Ram Jeevan Singh of Sabnima Gram Panchayat under the Scheme of Gram Jal Swastha Samiti for certain work but the work was not done and during investigation it was found that the said government money was misappropriated.

Learned counsel for the petitioner submits that coaccused, namely, Surendra Singh and Purushottam Kumar have already been granted bail vide orders dated 24.4.2012 and 6.12.2012 passed in Cr.Misc.No.1436 of 2012 and Cr.Misc.No.38826 of 2012 respectively with condition to deposit

Hence, having regard to the facts and circumstances of the case, let the petitioner above named, be released on provisional bail on furnishing bail bond of Rs.10,000/- with two sureties of the like amount each to the satisfaction of A.C.J.M., Barh ( Patna) in Athmalgola P.S. Case No.96 of 2009 with condition that he will deposit Rs.3/- lacs under the aforesaid scheme in two installments each of Rs.1.5 within two months from the date of receipt/production of a copy of this order. His provisional bail shall be confirmed on depositing of its second installment. Further condition is that he shall not dispose of his immovable property and he shall appear before the court below on each and every date fixed in the trial till disposal of the case and his absence on two consecutive dates without any valid ground shall be ground of cancellation of his bail bond.
