The petitioners have been arrested in connection with Sheikhpura P.S. Case No. 384 of 2011 registered under Sections 341, 323, 307 and 34 of the Indian Penal Code and Section 27 of the Arms Act.

It is alleged by the informant who is son of injured Shaildendra Mahto that when he was enjoying T.V. he heard hulla came out and saw Binod Mahto, Rakesh Mahto, Raj Bali Mahto and Om Matho were assaulted his father and Rakesh Mahto and Raj Bali Mahto shot fired upon his father. Furthermore, it is a peculiar case in which one son of injured Shailendra Mahto has lodged this case against another son Rakesh Mahto. The allegation is that four persons being relative including son of injured were assaulting to the victim out of which one of the coaccused Om Mahto caught injured and the son of the injured shot

fire and other relative Raj Bali Mahto also shot fire which hit at the chest of Shailendra Mahto.

Having regard to the facts and circumstances of the case, I am not inclined to grant bail to these petitioners. Accordingly, their prayer for bail is hereby rejected at this stage. However, the trial court is directed to expedite the trial and conclude the same preferably within a period of six months. However, if the trial is not concluded within a period of six months, then petitioners may renew their prayer for bail.
