JUSTICE DINESH KUMAR SINGH ORAL ORDER 02/ 10-01-2013 Heard learned counsels for the petitioners and the State. The petitioners are apprehending their arrest in a case registered for the offences punishable under Sections 302/34 of the Indian Penal Code.
There is some dispute over reaping the crop between the informant and mother of Amna Khatoon and after altercation allegedly more people came and assaulted the mother of the informant when it is specifically alleged that Amna Khatoon pressed the neck and sat over the chest of the mother of the informant as a result of which mother of the informant died. The medical report does not corroborate the accusation and considering the same Amna Khatoon and other have been granted regular

I see no reason for learned court below not to give same privilege to the petitioners, if the petitioners surrender before the learned court below within a period of six weeks from today in connection with Runni Saidpur P.S. Case No. 283 of 2011 pending in the court of learned CJM, Sitamarhi. It is expected from the learned court below to dispose of the bail application of the petitioners preferably on the same day.
With the aforesaid observation, this application is disposed of.
