3 07-01-2013 Heard the learned counsel for the petitioner and the State.
This is a petition for grant of regular bail for offence under Sections 420, 467, 468, 471, 419, 474 and 120B/34 of the Penal Code.
The petitioner was a gangster, indulged in fabricating and preparing the forged marks sheet for success in the combined test. The learned counsel for the petitioner submits that nothing has been recovered from the conscious possession of the petitioner. The petitioner has been arrested from a room where the articles for making fabrication and preparing forged marks sheet found and is in jail since 18.09.2012.
Hence, having regard to the facts and circumstances of the case, the petitioner, above named, is directed to be released on bail on furnishing bail bond of Rs.10,000/- (rupees ten thousand) with two sureties of the like amount each in connection with Kankerbagh P.S. Case No. 417 of 2012 to the satisfaction of the Chief Judicial Magistrate, Patna, subject to the condition that one of the bailors shall be a close relative of the petitioner and subject to the condition that the petitioner shall appear in Court on each and every date, fixed in the case and any absence, on two consecutive dates, without any reasonable ground to the satisfaction of the Court below, shall be a ground of cancellation of bail of the petitioner by the lower Court itself.
