2 07-01-2013 Heard learned counsel for the petitioner and learned counsel for the State.

This is a petition for grant of regular bail in a case under Sections 147, 148, 149, 447, 341, 504, 337, 427, 435, 436 and 353 of the Indian Penal Code as well as Sections 3/4 of the Prevention of Damage to Public Properties Act.

The alleged occurrence took place during the funeral of Late Brahmeshwar Mukhiya.

Learned counsel for the petitioner submits that from the order of learned Ad hoc Additional Sessions Judge-1, Patna, it is apparent that the only material against the petitioner is the self confession. The petitioner is in jail custody since 28.06.2012 and he has no criminal antecedent.

Hence, having regard to the facts and circumstances of the case, the petitioner above named is ordered to be released on bail on furnishing bail bond of Rs.10,000/- (ten thousand) with two sureties of the like amount each to the satisfaction of the learned Additional Sessions Judge-1, Patna in connection with Sachivalay P. S. Case No. 49 of 2012.
