This is a petition for grant of regular bail in a case under Sections 307, 379 and 342/34 of the Indian Penal Code as well as Section 27 of the Arms Act.

It is alleged that the mobile phone of the informant was used by the petitioner and the number shown to the informant has been disclosed by the petitioner.

Learned counsel for the petitioner submits that the only material against the petitioner is that the mobile of the informant was used by this petitioner by inserting his SIM. He further submits that the petitioner was the ex-driver of the informant and informant has not named this petitioner. He also submits that the petitioner has no criminal antecedent.

Hence, having regard to the facts and circumstances of the case, the petitioner above named is ordered to be released

on bail on furnishing bail bond of Rs.10,000/- (ten thousand) with two sureties of the like amount each to the satisfaction of the learned Chief Judicial Magistrate, Aurangabad in connection with Pauthu P. S. Case No. 20 of 2012, subject to the condition that one of the bailors shall be the close relative of the petitioner who will file affidavit to the effect that the petitioner has no criminal antecedent which fact should be verified by the court below and thereafter the petitioner be released on bail.
