This is a petition for grant of regular bail for offence under Sections 20B, 22 and 23 of the Narcotic Drugs and Psychotropic Substances Act, 1985.
The learned counsel for the petitioner submits that the petitioner was not arrested on spot and his name finds place on the confessional statement of the co-accused and the co-accused, Bishundeo Sao, having similar allegation, has been granted bail by this Court in Cr. Misc. No. 21072 of 2011.
Hence, having regard to the facts and circumstances of the case, the petitioner, above named, is directed to be released on bail on furnishing bail bond of Rs.10,000/(rupees ten thousand) with two sureties of the like amount each in connection with Birpur P.S. Case No. 97 of 2009, Special Case No. 7 of 2009(s) to the satisfaction of the Sessions' Judge-cumSpecial Judge, N.D.P.S. Act, Saharsa.
