3 04-04-2013 Heard learned counsel for the petitioner, informant and the State. This is a petition for grant of regular bail in a case under Sections 341, 323, 504, 307 and 379 of the Indian Penal Code. Subsequently Section 302/34 of the Indian Penal Code has also been added.
There is general and omnibus allegation of assault by lathi, danda and fist.
However, the post-mortem report suggests stitch wound injury. The post-mortem report also suggests time elapse since death within 6 to 24 hours.
Hence, having regard to the facts and circumstances of the case, the petitioner above named is ordered to be released on bail on furnishing bail bond of Rs.10,000/- (ten thousand) with two sureties of the like amount each to the satisfaction of the learned Chief Judicial Magistrate, Nalanda at Biharsharif in connection with Harnaut P. S. Case No. 145 of 2012.
