JUSTICE DINESH KUMAR SINGH ORAL ORDER 2 04-03-2013 Heard learned counsels for the petitioner and the State. The petitioner is apprehending arrest in a case registered for the offences punishable under Sections 120B, 406, 420, 467, 468 and 471 of the Indian Penal Code.

The FIR has been registered by the Registrar of the companies with the allegation that the petitioner being one of the directors of M/s. Cilson Organics Ltd. in the year 1996 issued prospectus giving false assurance and promise of issuance of public issue and collected money to the tune of Rs. 10,75,81,000/and subsequently disappeared.

It is submitted by learned counsel for the petitioner that by the Registrar of the Companies, Bihar and Jharkhand earlier a complaint case was filed with the same accusation in which the petitioner has been granted anticipatory bail vide Cr. Misc. No. 15436 of 2012 and the present FIR, though, instituted in the year 2005 but it is based on the complaint of the Registrar of the

Companies, Bihar and Jharkhand dated 10.06.2003. It is further submitted that the public issue of the equity shares were launched after due permission of the govt. and RBI and according to the prospectus huge investment was made in constructing the buildings but anti-social elements kidnapped the son of the petitioner, hence, he had to shift from the sate resulting into failure of part compliance of the terms of prospectus. It is further submitted that subsequently, various shareholders withdrew their complaint as they received their share certificates and with the same accusation another complaint was filed being Complaint Case Np. 46(C) of 2003 in which the petitioner is already on bail and the investigation is still pending.

Considering the aforesaid facts, let the above named petitioner be released on anticipatory bail, in the event of arrest or surrender before the learned Court below within a period of 12 weeks from today, on furnishing bail bond of Rs. 10,000/- (ten thousand) with two sureties of the like amount each to the satisfaction of the learned Chief Judicial Magistrate, Patna in connection with Patliputra P.S. Case No. 05 of 2005, subject to the conditions as laid down under Section 438(2) Cr.P.C.
