The petitioner being the then Registrar of Bihar Homeopathic Board is apprehending arrest in a case registered for the offences punishable under Sections 467,468 and 120B of the Indian Penal Code and sections 13(2) read with section 13(1)(d) of Prevention of Corruption Act, 1988.

It is alleged that Jamun Ram, the registration clerk of Homeopathic Board was trapped by the vigilance on 28.3.2011 while taking illegal gratification. It is also alleged against Jamun Ram that he used to realize Rs.2500 and Rs.2300 as registration fee from homeopathic doctors instead of Rs.750 when protest was made by several doctors. It is alleged against this petitioner that he allowed Jamun Ram after being released on bail to work as registration clerk again which suggests the culpability of this petitioner in realizing illegal gratification by Jamun Ram.

It is submitted that the letter of the petitioner dated 28.6.2011 issued vide memo no. 366 as contained in Annexure 4 reflects that Ashok Kumar, the other Clerk, Homeopathic Board was directed to do the work allocated to Jamun Ram earlier and to deposit the collected amount in the account of the Board.

It is submitted by learned counsel for the Vigilance that the petitioner was the Registrar and in his knowledge the excess money was being collected by Jamun Ram.

Considering the thrust of accusation against Jamun Ram, let the above named petitioner be released on anticipatory bail in the event of arrest or surrender before the learned Court below within a period of twelve weeks from today on furnishing bail bond of Rs. 10,000/- (ten thousand) with two sureties of the like amount each to the satisfaction of learned Additional Sessions Judge XIV, Patna (Special Judge, Vigilance, Patna) in connection with Special Case no. 24 of 2012 arising out of Vigilance P.S. Case no. 59 of 2012 subject to the conditions as laid down under Section 438(2) Cr.P.C.
