The petitioner is apprehending arrest in a case registered for the offences punishable under Sections 420,406,467,468,471 and 120B of the Indian Penal Code.

It is alleged that the petitioner assured that the informant’s son will be admitted in MS course in some medical college in Gujrat when rupees eleven lacs was paid to the petitioner and co accused Rajesh Kumar alias Abhishek.

It is submitted that the informant lodged a case in Gujrat on 7.4.2010 where he specifically alleged that rupees eleven lacs was taken by Rajesh Kumar as he was only accused in the said case. Rajesh Kumar’s statement was recorded by the court in Gujrat where Rajesh Kumar did not name this petitioner and after recording statement, Rajesh Kumar was granted bail. It is further submitted that in the present case, it is claimed by the informant that part of the money was taken by the petitioner when petitioner

Considering the fact that earlier case was filed in Gujrat in which the petitioner was not named by co accused Rajesh, let the above named petitioner be released on anticipatory bail in the event of arrest or surrender before the learned Court below within a period of twelve weeks from today on furnishing bail bond of Rs. 10,000/- (ten thousand) with two sureties of the like amount each to the satisfaction of learned SDJM, Dehri, Rohtas (Sasaram) in connection with Dehri (Dalmianagar) P.S. Case No. 618 of 2011 subject to the conditions as laid down under Section 438(2) Cr.P.C.
