It is alleged that the petitioner has surreptitiously withdrawn Rs.10,60000/from the Account of School Education Committee and made expenditure personally.

Learned counsel for the petitioner submits that he has submitted TCDC Bill. However, it is alleged that the Block Education Officer also on the request of the District Education Officer ordered to withdraw the amount for defalcation of the said amount and the petitioner remained absconder and hence, he was suspended.

Hence, having regard to the facts and circumstances of

the case, let the petitioner above named, in the event of his arrest/surrender before the court below within four weeks from today along with all the relevant documents be released on bail on furnishing bail bond of Rs.10,000/- with two sureties of the like amount each to the satisfaction of the C.J.M., Ara, Bhojpur, in Ara (Mufasil) P.S. Case No.80/11 subject to the condition as laid down under section 438(2) of Cr.P.C. with condition that he will give all the papers to the I.O. to the satisfaction of the court below.
