Heard learned counsel for the petitioner and learned counsel for the State.
This is a petition for grant of regular bail in a case under Sections 302/34 of the Indian Penal Code as well as Section 27 of the Arms Act.
The First Information Report is against unknown.
The name of the petitioner finds place on the basis of suspicion. However, the petitioner remained absconding for 14 years.
Learned counsel for the petitioner submits that the petitioner is the co-villager of the informant and the process under Sections 82 and 83 Cr. P. C. though commenced but nothing was seized and there is no mention about the property.
Hence, having regard to the facts and circumstances of the case, the petitioner above named is ordered to be released on bail on furnishing bail bond of Rs.10,000/- (ten thousand)

with two sureties of the like amount each to the satisfaction of the learned Judicial Magistrate-1st Class, Masaurhi in connection with Masaurhi (Bhagwanganj) P. S. Case No. 104 of 1998, subject to the condition that the petitioner shall appear in the case on each and every date fixed by the court below and any absence of the petitioner shall be subject to the satisfaction of the court below on reasonable grounds and if the petitioner shall be absent on two consecutive dates will itself be a ground for cancellation of the bail bond of the petitioner.
