This is a petition for regular bail for the offence under
Section 392 of the I.P.C. and section 411 was added later on.
There is allegation that the looted motor cycle, colour
T.V., D.V.D., SIM etc. were recovered from the house of the petitioner and some looted articles were also recovered from the possession of the co-accused, Shankar Ram.
Learned counsel for the petitioner submits that the petitioner is not named in the F.I.R. rather he has been made accused on the basis of the confessional statement of co-accused, Banty @ Vidya Nand Sinha. He has no criminal antecedent. He was not put on test identification parade.
However, it is alleged that the occurrence is dated
11.4.2012 and the recovery was made after two weeks.
Hence, having regard to the facts and circumstances

of the case, let the petitioner above named be released on bail on furnishing bail bond of Rs.10,000/- with two sureties of the like amount each to the satisfaction of Sri R.K.Mishra, J.M.-1st Class, Biharsharif , Nalanda, in Rahui (Vena) P.S. Case No.57 of 2012 / G.R. No.882 of 2012.
