Petitioner is an accused in connection with Mithanpura P.S. No.109 of 2013 registered for the offences punishable under Sections 302 and 34 of the Indian Penal Code.

Learned counsel appearing on behalf of the petitioner submits that the petitioner and the informant belong to the same Mohalla and the petitioner is not named in the F.I.R. by the informant Narayan Ram. It is further submitted that it would itself appear from the F.I.R. that the petitioner had made complaint about the threatening given by the deceased Satya Narayan Ram, who had criminal tendency, to his son by showing knife. It is also submitted that the petitioner has been falsely implicated in this case later on

during investigation. It is averred that in fact, there is no eye witness to the occurrence and the informant has himself stated about the committing of murder of his deceased brother Satya Narayan Ram by unknown persons. It is also submitted that the petitioner is in custody since 01.05.2013 and has no criminal antecedent.

The prosecution case, as narrated in the fardbeyan of the informant Narayan Ram, is that on 21.04.2013 at 11 A. M. the petitioner came to the house of the informant Narayan Ram in search of his brother Satya Narayan Ram and made complaint about giving threatening by his brother Satya Narayan Ram to his son by showing knife. Later on, on 22.04.2013 at about 2.45 A.M., Ward Member Raja Ram, Ganesh Ram and Kamal Ram came to the informant and informed him that the dead body of his brother Satyanarayan Ram had been thrown. Thereafter the informant, several persons of the Mohalla and also the police officials of Mithanpura Police Station went at the place of occurrence and saw the dead body of his brother Satya Narayan Ram sustaining several injuries. It is further case of the prosecution that his brother Satya Narayan Ram, who was a criminal, had gone in jail in cases of murder and theft.

Having regard to the facts and circumstances of the case, the petitioner above named is directed to be released on bail on his furnishing bail bonds of Rs.10,000/- (Rupees ten thousand) with two sureties of the like amount each to the satisfaction of learned Chief Judicial Magistrate, Muzaffarpur in connection with Mithanpura P.S. Case No.109 of 2013 corresponding to G.R. No.1597 of 2013.
