4 04-09-2013 Heard learned counsel for the petitioner and the learned Additional Public Prosecutor for the State. The petitioner is accused in Sessions Trial No. 429 of 2012 arising out of Hilsa P. S. Case No. 209 of 1999 registered under sections 307/ 324 of the Indian Penal Code and 27 Arms Act pending in the Court of Additional Sessions Judge IIIrd, Hilsa, Nalanda.

Learned counsel appearing on behalf of the petitioner submits that earlier the prayer for bail of the petitioner was rejected by this Court vide order dated 10.10.2012 passed in Cr. Misc. No. 37205 of 2012.

trial all the witnesses cited in charge sheet have been examined except the doctor and Investigating Officer and the case is pending for examination of doctor & I.O.

Earlier the prayer of bail of the petitioner was rejected taking into consideration the allegation of causing firearm injury by the petitioner at temporal region of the injured. As such, I am not inclined to allow the prayer of bail to the petitioner and accordingly, the prayer for bail of the petitioner is rejected.

The Trial Court is directed to take steps to examine the I.O. and Doctor in Sessions Trial No. 429 of 2009 and dispose of the case within four months, if the trial is not concluded within said period the petitioner would be at liberty to renew his prayer for bail.
