JUSTICE RAJENDRA KUMAR MISHRA ORAL ORDER 2 04-09-2013 Heard learned counsel for the petitioner and the learned Additional Public Prosecutor of the State. The petitioner is accused in Excise Case No. 1 of 2013 registered for offences under section 47A and 47F of the Excise Act. It appears from the prosecution case itself that the case has been instituted on the basis of the written report by Shri Raj Kishore Prasad Singh, Sub Inspector, Excise, Jehanabad in which 45 liter of illicit liquor, 1000 Kg Jawa Mahua as well as equipment for manufacturing wine had been recovered. Learned counsel appearing on behalf of the petitioner

submits that the petitioner surrendered before the learned Court below on 30.07.2013 and since then he is in jail custody. It is also submitted that the wine and the equipments have not been recovered from the house or conscious possession of the petitioner and petitioner has no criminal antecedent as stated in paragraph-3.
Having regard to the facts and circumstances of the case, the above named petitioner, is directed to be released on bail on his furnishing bail bond of Rs. 10,000/-(Rupees Ten thousand) with two sureties of the like amount each to the satisfaction of the Judicial Magistratge 1st class, Jehanabad with Excise Case No. 1 of 2013.
