3 22-01-2013 Heard learned counsel for the petitioner and learned counsel for the State.

The petitioner has been arrested in connection with Laukaria P.S. Case No. 09 of 2012, registered under Sections 147, 148, 149, 323, 324, 307, 448 and 302 of the Indian Penal Code.

There is specific allegation that one of the co-accused namely, Bishwanath Sah assauled the Umesh Sah(son of the informant) by iron rod and Sugan Sah assaulted Dinesh Sah.

Learned counsel for the petitioner submits that role attributed of assault by Bishwanath to Umesh Sah and Sugan Sah assaulted the Dinesh Sah. It has also been pointed out that no injury was found on the person of Umesh Sah.

Having regard to the facts and circumstances of the case, the above named petitioner is directed to be released on bail on furnishing bail bond of Rs. 10,000/- (Ten thousand) with two sureties of the like amount each to the satisfaction of Additional Chief Judicial Magistrate, Bagaha, West Champaran, in connection with Laukaria P.S. Case No. 09 of 2012.
