5 22-01-2013 Heard learned counsel for the petitioners and learned counsel for the State.

This is a petition for quashing the order dated 20.05.2011 passed in Complaint Case No. 470 of 2011, by which learned S.D.J.M. Saran, by which he has been taken cognizance for offence under Sections 498A, 323, 341 and 379/34 of the Indian Penal Code against these petitioners as well as for quashing the entire criminal proceeding.

It is submitted that the matter was sent to Mediation Board and it has been reported by the Mediator that dispute between the parties has been resolved. Cash amount and other

belonging ornament, pots, clothes etc. worth Rs. 5,30,000/- given to accused petitioner by Opposite Party No. 2 in which Rs. 5,15,000/- has been taken return back from accused petitioner. The accused petitioner would pay Rs. 15,000/- and in the light of compromise the above proceeding be quashed. The complainant who is father of the victim wife Deep Shikha has signed the memorandum of compromise and the husband-petitioner no.3 has also signed memorandum of compromise.

Hence in view of the fact mentioned above both parties have compromised and amount of Rs. 5,15,000/- has already been paid and Rs.15,000/- has remained to be paid. Hence entire criminal proceeding is disposed of in terms of compromise between the parties subject to payment of Rs.15,000/- by the petitioners to the complainant or the victim-wife Deep Shikha to the satisfaction of the court below.

Learned counsel for the petitioners submits that petitioner no. 1 has already been died hence the name of petitioner no. 1 be deleted.

In view of the fact the petition is allowed with condition as mentioned above.
