Petitioner being husband of the informant is in jail custody since 29.11.2012 in a case registered for the offences punishable under Sections 498 A, 494 of the Indian Penal Code and ¾ of Dowry Prohibition Act.
According to prosecution case itself, the marriage of petitioner was solemnized with the informant in the year 2007 and later on, informant gave birth to a female child out of the aforesaid wedlock. There is allegation that petitioner used to torture the informant due to non fulfilment of dowry demand and later on, he solemnized his marriage with one Sonia but it appears to me that dispute arose between the parties due to so-called solemnization of second marriage by the petitioner.
Considering the aforesaid facts and circumstances as well as submissions of the parties, let the petitioner be released on
