2 13-09-2013 Heard learned counsels for the petitioner and
the State.
Petitioner being husband of the Panchayat Mukhiya is apprehending his arrest in a case registered for the offences punishable under Sections 7 of the Essential Commodities Act.
The son of Nirmal Chandra Khan caught the petitioner while taking away four bags of rice of Mid-day-meal when the enquiry was conducted by Sanjay Kumar, District Incharge, Mid-day-meal and thereafter the present case was lodged.
It is submitted by learned counsel for the petitioner that son of Nirmal Chandra Khan was on litigating term with the petitioner since uncle of the petitioner filed a case against Nirmal Chandra Khan, hence the accusation has been

levelled when for the occurrence of 07.12.2012 the F.I.R. has been registered on 12.12.2012.
Considering the delayed lodging of the case, let the petitioner, above named, in the event of his arrest or surrender before the Court below within a period of 12 weeks from today, be released on anticipatory bail on furnishing bail bond of Rs. 10,000/-(ten thousand) with two sureties of the like amount each to the satisfaction of learned Sub-Divisional Judicial Magistrate, Saharsa in connection with Bangaon P.S. Case No. 99 of 2012, subject to the conditions as laid down under Section 438(2) of the Cr.P.C.
