The accusation is of making assault to the informant, his brother and uncle when the uncle of the informant succumbed to the injuries. Initially the case was registered under Section 307 IPC and subsequently Section 302 IPC was added.
It is submitted by learned counsel for the petitioners that the accusation of assault is omnibus and general when both sides

are claiming same land and in the background of land dispute, the accusation has been levelled when there is counter version of the occurrence also.
It is submitted by learned counsel for the informant that the informant claims the land in question by virtue of registered sale deed.
Let the learned court below consider the regular bail of the petitioners if the petitioners surrender within a period of six weeks.
With the above observation, this application is, accordingly, disposed off.
Let the order be transmitted to the learned court below through fax at the cost of the petitioners.
