The petitioners are apprehending arrest in a case registered for the offences punishable under Sections302/34 and 120B of the Indian Penal Code and Section 27 of the Arms Act.

It is alleged that unknown extremists killed the husband of the informant who was ex-Mukhiya when the suspicion was raised against the petitioners that they have conspired with the extremists.

It is submitted by learned counsel for the petitioners that nothing has been bought on record to suggest that the petitioners were conspirators of the extremists when the informant has admitted that her husband was killed by some unknown extremists. A statement has been made in para 13 of the petition that the petitioners have no criminal antecedent.

Considering the suspicious nature of accusation, let the above named petitioners be released on anticipatory bail, in the

event of arrest or surrender before the learned Court below within a period of 12 weeks from today, on furnishing bail bond of Rs. 10,000/- (ten thousand) each with two sureties of the like amount each to the satisfaction of the learned Sub-divisional Judicial Magistrate, Sherghati, Gaya in connection with Dumariya P.S. Case No. 33 of 2011, subject to the conditions as laid down under Section 438(2) Cr.P.C.

The bail bonds of the petitioners shall be accepted on verification of the fact that the petitioners have no criminal antecedent.
