The petitioner being the Panchayat Secretary is apprehending his arrest in a case registered for the offences punishable under Sections 409, 420, 467, 468, 471 and 120B/34 of the Indian Penal Code.

The accusation is of misappropriating the scholarship money to the tune of Rs.36,360/-.

It is submitted by learned counsel for the petitioner that the petitioner has already distributed the said amount, but the said fact has not been incorporated in the case diary.

The petitioner undertakes to deposit Rs.36,360/- before the learned court below, which will be invested by the learned court below in some fixed

deposit scheme in connection with the present case, which will be subject to the result of the case.

On deposit of the aforesaid amount, let the above named petitioner be released on anticipatory bail in the event of his arrest or surrender before the learned court below within a period of twelve weeks from today, on furnishing bail bond of Rs.10,000/- (Ten thousand) with two sureties of the like amount each to the satisfaction of learned ACJM, Rosera, District - Samastipur in connection with Rosera P.S. Case No. 116 of 2012, subject to the conditions as laid down under Section 438(2) of the Cr.P.C.
