This petition for anticipatory bail has been filed on behalf of the petitioners who apprehend their arrest for the offences alleged under Sections 302/34 of the I.P.C.

An earlier petition for anticipatory bail was rejected by this Court in its order dated 23.01.2013 in Cr. Misc. No. 1915 of 2013.

It is submitted that a charge-sheet has since been submitted against the deceased’s husband namely Pramod Yadav under sections 498A/306/34 of the I.P.C. on finding that it was the said Pramod Yadav who used to torture the deceased leading her to commit suicide and further that the said Pramod Yadav has been granted regular bail by this Court in Cr. Misc. No. 43905 of 2012.

Considering the above facts, in the event of arrest or surrender before the court below within six weeks from the date of communication of this order, let the above named petitioners be released on bail on furnishing bail bonds of Rs.10,000/- (ten thousand) each with two sureties of like amount each to the satisfaction of learned Chief Judicial Magistrate, Darbhanga, in connection with Baheri P.S. Case No. 159 of 2012, subject to the conditions as laid down under Section 438 (2) Cr.P.C.
