JUSTICE DINESH KUMAR SINGH ORAL ORDER 2 10-09-2013 Heard learned counsels for the petitioner and the State. The petitioner is apprehending arrest in a case registered for the offences punishable under Section 393 of the Indian Penal Code and Section 25(1-b), 26 and 34 of the Arms Act.

On chase, one Papu was apprehended from whom one pistol and two live cartridges were recovered who confessed that the pistol was given to him by this petitioner.

It is submitted by learned counsel for the petitioner that Papu did not give the parentage and other address of the petitioner when in the formal part of the FIR, the petitioner was not named as an accused. A statement has been made in para 12 of the petition that the investigation is still pending and further statement has been made in para 13 of the petition that the petitioner has no criminal antecedent.

Considering the aforesaid facts, let the above named petitioner be released on anticipatory bail, in the event of arrest or

surrender before the learned Court below within a period of 12 weeks from today, on furnishing bail bond of Rs. 10,000/- (ten thousand) with two sureties of the like amount each to the satisfaction of the learned Chief Judicial Magistrate, Saran, Chapra in connection with Chapra Muffasil (Khaira) P.S. Case No. 201 of 2005, subject to the conditions as laid down under Section 438(2) Cr.P.C.
