The petitioner being the husband of the informant is languishing in jail since 26.02.2013 in a case registered for the offences punishable under Sections 498A, 379 and 120B/34 of the Indian Penal Code.
The accusation is of torture.
It is submitted by learned counsel for the petitioner that the petitioner is still ready to keep the informant but the offer of the petitioner is not acceptable to the informant which gets reflected from the impugned order.
Considering the nature of accusation and period under custody, let the above named petitioner, be released on bail, on furnishing bail bond of Rs. 10,000/- (ten thousand) with two sureties of the like amount each to the satisfaction of learned Chief Judicial Magistrate, Nalanda at Biharsharif in connection with Nalanda P.S. Case No. 05 of 2013.
