Informant Gulfi Devi, Bhaujai of deceased Mohan Rai shown suspicion against the petitioner, her own Gotani Sumitra Devi and other for causing murder of her Dewar Mohan Rai who was consistently protested their illicit relationship.
Contention on behalf of the petitioner is that save and except suspicion shown by the witnesses on account of persisting illicit relationship, nothing more has been collected by the investigating officer. Also submitted that Sumitra Devi has already been granted regular bail vide Cr.Misc.No.1924 of 2013 and more or less the case of the petitioner stood on similar footing. Also submitted that petitioner is in custody since 08.07.2012 though the order impugned suggests criminal antecedent of the petitioner.
On the other hand learned APP opposed the prayer for

bail and submitted that the investigation is still continuing.
In the aforesaid facts and circumstances of the case, petitioner, namely, Tohid Mian @ Tohid Ansari is directed to be released on bail on furnishing bail bond of Rs.10,000/-(ten thousand) with two sureties of the like amount each to the satisfaction of Chief Judicial Magistrate, Banka in Banka P.S.Case No.86 of 2012.
