| On the point of lethal weapon informant was deprived of the motorcycle, cash as well as mobile set from his elder brother and during course of commission of the crime the miscreants have concealed their face. |
It has been submitted on behalf of the petitioner that without any basis or foundation, he has been remanded in this case from Jhajha P.S.Case No.02 of 2012 and to justify the same, extra judicial confessional statement of co-accused Sudhir Yadav has been incorporated. It has been submitted that the learned lower court had rejected the prayer for bail only on the ground that the parts of the looted motorcycle of the present case was used in the motorcycle which was seized in connection with Jhajha P.S.Case No.02 of 2013. On the other hand learned APP opposed the prayer for bail and submitted that complicity of the petitioner with the crime so alleged is apparent therefrom.
In the aforesaid facts and circumstances of the case, petitioner, namely, Sahdeo Rabidas is directed to be released on bail on furnishing bail bond of Rs.10,000/-(ten thousand) with two sureties of the like amount each to the satisfaction of Chief Judicial Magistrate, Jamui in Jhajha P.S.Case No.180 of 2012.
