During course of brawl going on in between Rambabu Yadav and Rohit it has been alleged that petitioner and Devki Devi arrived at the scene having Katta in their hand and during said course it has been alleged that petitioner had caught hold Rambabu Yadav, father of Niraj Yadav (informant) who was shot at by Rohit Yadav, on account of which he died instantaneously.
It has been submitted on behalf of petitioner that he is not an assailant and happens to be under custody since 05.11.2012.
At the other hand, the learned Additional Public Prosecutor opposed the prayer and submitted that petitioner during course of occurrence facilitated the murder at the end of Rohit Yadav.
