JUSTICE DINESH KUMAR SINGH ORAL ORDER 2 16-05-2013 Petitioner is apprehending his arrest in a case registered for the offences punishable under Section 420 of the I.P.C. It is alleged that in a business partnership the informant made investment of Rs. 1,55,000/- with the petitioner when the petitioner failed to make payment of Rs. 1,55,000/-.
It is submitted by learned counsel for the petitioner that earlier anticipatory application was disposed off before learned Sessions Judge on statement of the petitioner that petitioner has already paid Rs. 85,000/- when rest of Rs. 70,000/- was undertaken to be paid to the informant but the informant denied to have received amount of Rs. 85,000/- from the petitioner and on that ground the subsequent anticipatory bail of the petitioner was rejected by learned court below.
Considering the accusation arising out of

contractual relationship between the parties, let the petitioner, above named, in the event of his arrest or surrender before the Court below within a period of 12 weeks from today, be released on anticipatory bail on furnishing bail bond of Rs. 10,000/-(ten thousand) with two sureties of the like amount each to the satisfaction of learned Chief Judicial Magistrate, Nawadah in connection with Rajauli P.S. Case No. 250 of 2012, subject to the conditions as laid down under Sections 438(2) of the Cr. PC
