The petitioners are apprehending arrest in a case registered for the offences punishable under Sections 295A, 296, 353, 337 and 427/34 of the Indian Penal Code and Section 3(5) of the Prevention of Damage to Public Property Act. for non-compliance of peremptory order but in pursuance to subsequently order of co-ordinate Bench dated 06.07.2012 passed in Cr. Misc. No. 37051 of 2011, the present application has been filed.

The accusation is of throwing bricks on the mob and when the administration tried to control then glass pans of the government vehicle was damaged.

It is submitted by learned counsel for the petitioners that the accusation is against the mob when settlement has been made between the communities. A statement has been made in para 12 of the petition that the petitioners have no criminal antecedent.

Considering the aforesaid facts, let the above named petitioners be released on anticipatory bail, in the event of arrest or surrender before the learned Court below within a period of 12 weeks from today, on furnishing bail bond of Rs. 10,000/- (ten thousand) each with two sureties of the like amount each to the satisfaction of the learned Sub-divisional Judicial Magistrate, Sikrahna, Motihari in connection with Pakaridayal P.S. Case No. 77 of 2010, subject to the conditions as laid down under Section 438(2) Cr.P.C.
