The petitioner is an accused in a case instituted under Sections 302 and 120 IPC. The son of the informant was killed by knife pierced on his abdomen, chest and hand. The informant has alleged that the deceased had developed intimate relationship with the wife of the petitioner. The petitioner upon return from his place of work committed murder of the son of the informant. In course of investigation the weapon of assault (blood stained knife) was also recovered on the basis of the confessional statement of the petitioner.

Learned counsel for the petitioner submits that there is no eye witness to the occurrence. The petitioner carries clean antecedent and is lodged in jail custody since 28.1.12. In the FIR on suspicion four accused persons including the petitioner was/were named. Two of them have since been released on bail.

Considering the allegations and the materials collected in course of investigation as reflected from the impugned order, the prayer for bail is rejected.

The petitioner is, however, granted liberty to renew prayer for bail in the Court below itself if the trial does not record adequate progress within 06 months from the date of receipt/production of a copy of this order.
