As per the prosecution case, the husband of the informant was caught hold by three named accused persons including the petitioner whereafter co accuseds Md. Gufran and Md. Rustam are said to have fired on the deceased causing his death on the spot. Learned counsel for the petitioner submits that as per the allegation in the FIR he is not the assailant. The petitioner is lodged in jail custody since 21.12.2012. The two accused persons who are said to have caught along with the petitioner have since been released on bail by this Court. Counsel for the petitioner has handed in a web copy of the order dated 18.07.2013 passed in Cr. Misc. No. 22522 of 2013 in order to support the aforesaid contention. The aforesaid web copy has been taken on record marked ‘x’ for identification. Referring to paragraph 10 of the

application it has been submitted that the petitioner has no criminal antecedent.
In the facts and circumstances of the case, the petitioner abovenamed is directed to be released on bail on furnishing bail bond of Rs. 10,000/- with two sureties of the like amount each to the satisfaction of ACJM, Naugachia, Bhagalpur in connection with Naugashia P.S. Case No. 243/2012 on condition that one of the bailors shall be his own/close family member.
